This Legal Notice sets out the general terms and conditions governing access to and use of this website, hereinafter referred to as “the Website”. Use of the Website implies the express and full acceptance of these general terms and conditions in the version published at the time the user accesses it, without prejudice to any specific terms and conditions that may apply to certain services offered through the Website.

Access to the Website is free of charge, except for the cost of the connection through the telecommunications network provided by the access provider contracted by users.

Certain services are exclusively available to our clients and access to them is restricted.

Use of the Portal confers the status of Portal user (hereinafter, the ‘User’) and implies acceptance of all the terms and conditions included in this Legal Notice. Some Portal services available to Internet users or exclusively to Grupo Casanis clients may be subject to specific terms and conditions, regulations and instructions which, where applicable, replace, supplement and/or amend this Legal Notice and which must be accepted by the User before the corresponding service is provided.

This Website and the content it contains are protected by current intellectual property legislation.

Grupo Casanis owns or holds licences to all intellectual and industrial property rights relating to its Website, as well as to the elements contained therein. Therefore, the reproduction, distribution, public communication and transformation of all or part of the content of this Website for commercial purposes, on any medium and by any technical means, is expressly prohibited without the authorisation of Terms and Conditions.

The trademarks, trade names and distinctive signs are owned by Grupo Casanis under industrial or intellectual property rights, and access to the Portal shall not be construed as granting any rights over such trademarks, trade names and/or distinctive signs.

All products and services featured on these pages that are NOT owned by Grupo Casanis are registered trademarks of their respective owners and are recognised as such by our company. They appear on the Grupo Casanis Website solely for promotional and information-gathering purposes. Their owners may request the modification or removal of information belonging to them.

The User undertakes to make proper use of the Portal in accordance with the law and this Legal Notice. The User shall be liable to Grupo Casanis or third parties for any loss or damage that may arise as a result of a breach of this obligation.

The use of the Portal for purposes that may damage the assets or interests of Grupo Casanis or third parties, or that in any other way overload, damage or render unusable the networks, servers and other computer equipment (hardware) or computer products and applications (software) of Grupo Casanis or third parties, is expressly prohibited.

The User undertakes to use the Content in accordance with the law and this Legal Notice, as well as with any other terms, regulations and instructions that may apply in accordance with Clause 1.
By way of example only, and in accordance with applicable legislation, the User must refrain from:

Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Content except where authorised by law or expressly permitted by Grupo Casanis or, where applicable, by the holder of the corresponding exploitation rights.
Reproducing or copying for private use any Content that may be considered Software or a Database under current intellectual property legislation, as well as publicly communicating it or making it available to third parties where such acts necessarily involve reproduction by the User or a third party.
Extracting and/or reusing all or a substantial part of the Content forming part of the Portal, as well as any databases that Grupo Casanis makes available to Users.

Internet users wishing to include links from their own websites to the Portal must comply with the conditions set out below. Lack of knowledge of these conditions shall not exempt them from any liability arising under the law:

The link may only point to the home page or main page of the Portal and may not reproduce it in any form (online links, copies of texts, graphics, etc.).
In all cases, and in accordance with the legislation applicable and in force at any given time, it is prohibited to establish frames of any kind around the Portal or to allow the Content to be viewed through Internet addresses other than those of the Portal and, in any event, where it is displayed together with content unrelated to the Portal in such a way that: (I) it causes, or may cause, error, confusion or deception among users as to the true origin of the service or Content; (II) it constitutes an act of unfair comparison or imitation; (III) it seeks to take advantage of the reputation and prestige of the Grupo Casanis brand; or (IV) it is otherwise prohibited by applicable legislation.
The page containing the link must not make any false, inaccurate or incorrect statements regarding Grupo Casanis, its partners, employees, clients or the quality of the services it provides.
Under no circumstances may the page containing the link state that Grupo Casanis has consented to the inclusion of the link or that it otherwise sponsors, collaborates with, verifies or supervises the sender’s services.
The use of any word mark, figurative mark, combined mark or any other distinctive sign belonging to Grupo Casanis on the sender’s page is prohibited, except where permitted by law or expressly authorised by Grupo Casanis and provided, in such cases, that a direct link to the Portal is allowed in the manner established in this clause.
The page establishing the link must fully comply with the law and may under no circumstances provide or link to its own content or third-party content that: (I) is unlawful, harmful or contrary to morality and accepted standards of conduct (pornographic, violent, racist, etc.); (II) induces or may induce the User to falsely believe that Grupo Casanis subscribes to, endorses, supports or in any way backs the sender’s ideas, statements or expressions, whether lawful or unlawful; or (III) is inappropriate or irrelevant to the activity of Grupo Casanis, taking into account the location, content and subject matter of the sender’s website.

Grupo Casanis accepts no responsibility for decisions made on the basis of information provided on the Portal, nor for any loss or damage suffered by the User or third parties as a result of actions based solely on information obtained from the Portal.

Access to the Portal does not imply any obligation on the part of Grupo Casanis to monitor the absence of viruses, worms or any other harmful computer elements.
It is the User’s responsibility, in all cases, to have appropriate tools available for the detection and removal of harmful computer programs.
Grupo Casanis shall not be liable for any damage caused to the computer equipment of Users or third parties during the provision of the Portal service.

Access to the Portal requires services and supplies provided by third parties, including transmission through telecommunications networks whose reliability, quality, continuity and operation are beyond the control of Grupo Casanis. Consequently, services provided through the Portal may be suspended, cancelled or become inaccessible before or during the provision of the Portal service.
Grupo Casanis shall not be liable for any loss or damage of any kind suffered by the User as a result of failures or disconnections in telecommunications networks causing the suspension, cancellation or interruption of the Portal service either during or prior to its provision.

The Portal access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In such cases, Grupo Casanis acts as an intermediary service provider in accordance with Article 17 of Law 34/2002 of 12 July on Information Society Services and Electronic Commerce (LSSI) and shall only be liable for the content and services supplied on Linked Sites to the extent that it has actual knowledge of their unlawful nature and has failed to disable the link with due diligence. If the User considers that a Linked Site contains unlawful or inappropriate content, they may notify Grupo Casanis in accordance with the procedure and effects established in Clause 6, without such notification in any case implying an obligation to remove the corresponding link.
Under no circumstances shall the existence of Linked Sites imply the existence of agreements with their managers or owners, nor shall it imply any recommendation, promotion or identification by Grupo Casanis with the statements, content or services provided through them.
Grupo Casanis has no knowledge of the content and services of Linked Sites and therefore accepts no liability for any damage arising from the unlawfulness, quality, outdated nature, unavailability, error or uselessness of the content and/or services of Linked Sites, or for any other damage that is not directly attributable to Grupo Casanis.

If the User or any other Internet user becomes aware that Linked Sites lead to pages whose content or services are unlawful, harmful, degrading, violent or contrary to morality, they may contact Grupo Casanis providing the following information:

• Personal details of the person making the report: name, address, telephone number and email address;
• A description of the facts demonstrating the unlawful or inappropriate nature of the Linked Site;
• In the event of infringement of rights, such as intellectual or industrial property rights, the personal details of the holder of the infringed right where this is a person other than the person making the report.
• They must also provide documentation proving the rights holder’s entitlement and, where applicable, evidence of authority to act on behalf of the rights holder where this is a person other than the person making the report; an express statement confirming that the information contained in the complaint is accurate.

Receipt by Grupo Casanis of the notification provided for in this clause shall not, pursuant to the LSSI, constitute actual knowledge of the activities and/or content indicated by the person making the report.
They must also provide documentation proving the rights holder’s entitlement and, where applicable, evidence of authority to act on behalf of the rights holder where this is a person other than the person making the report.

All notices and communications made by the parties shall be valid in accordance with the means permitted by law. Those relating to this Portal shall be deemed effective for all purposes if made through the Portal itself.

Grupo Casanis reserves the right to make, without prior notice, any changes it deems appropriate to its Website, including changing, deleting or adding both the content and services provided through it and the way in which they are presented.
Furthermore, these terms and conditions may be changed at any time. Any amendments shall take effect from the moment they are published.

Grupo Casanis is present on various social media networks and platforms. Therefore, when accessing any of these or other networks, users should bear in mind that the applicable terms of use are those established by each platform, in which Grupo Casanis has no involvement.

This Legal Notice is governed in all respects by Spanish law. Whenever applicable law permits waiver of the legally established jurisdiction, the courts of Málaga shall be designated as having jurisdiction to resolve any disputes, and the User expressly waives any other jurisdiction to which they may otherwise be entitled.
